Festus's venue proposal leads Paul to appeal
A new governor's favor and an unproved docket push Paul to Caesar
Three days after arriving, Festus goes up from Caesarea to Jerusalem. The chief priests and principal men inform him against Paul and ask as a favor that Paul be sent to Jerusalem, planning an ambush. Festus says Paul is being kept at Caesarea and that they may accuse him there. After more than ten days he sits on the tribunal. Accusers bring many serious charges they cannot prove. Paul says he has offended neither against the Jewish law, nor the temple, nor Caesar. Festus, wishing to do the Judeans a favor, asks whether Paul will go up to Jerusalem to be tried before him. Paul answers that he stands at Caesar's tribunal, has done the Jews no wrong, does not refuse to die if he has done anything worthy of death, but will not be handed over as a favor. He appeals to Caesar. After conferring with the council, Festus says, "Hast thou appealed unto Caesar? unto Caesar shalt thou go."
Appeal procedure for a Roman citizen is historically complex. Paul's words accept lawful death if guilty without making capital punishment a Christian ideal. Imperial agency, not a spiritualized destiny, now controls the venue. The ambush request remains a particular plot, not a people.
How this should shape us
Use a lawful appeal when venue and ambush threaten a fair hearing, while admitting that such rights are unevenly available. Do not baptize empire as savior, and do not use Paul's willingness to die if guilty as a reason to promote execution.
